What is the most important regulatory takeaway?

Buy compliance controls for the activities your supplier performs—not a generic promise that its GEO service is compliant. Review generation, sponsored comparisons, customer-data processing, automated collection and publishing synthetic content require different assessments. The relevant official materials address these activities separately; they do not establish a single certification for AI search visibility. (ftc.gov)

Our recommended priorities are:

  1. Check authenticity and evidence before funding visibility work. The FTC’s reversal of its Rytr order did not remove its separate consumer-review rule or advertising-substantiation requirements. (ftc.gov)
  2. Review customer-data flows now. California’s new privacy regulations became effective on 1 January 2026, with separate implementation dates for risk assessments, automated decisionmaking and cybersecurity audits. (cppa.ca.gov)
  3. Prepare for genuinely applicable deadlines—not every AI-law headline. Colorado has an active consultation closing on 26 October 2026, subject to a hearing-extension provision. EU transparency obligations already apply, with a narrow provider-side transition ending on 2 December 2026. (coag.gov)
  4. Recheck California synthetic-content advice written before September 2026. A newly signed advertising-disclosure law and further transparency amendments require a fresh review rather than reliance on older summaries. Some chaptered-text details remain a verification gap in this briefing. (gov.ca.gov)

Measurement convention: this briefing treats a mention as being named, a citation as receiving a source link, and a recommendation as being presented as a suitable choice. Require suppliers to report these separately.

This is procurement-oriented research, not a legal opinion or an exhaustive fifty-state survey. Recommendations below are identified as buyer actions; they are not all statutory requirements.
